Terms of Service & Telehealth Consent

Please review the legal terms governing digital consultations, electronic health records, herbal pharmacy dispensing, and diagnostic services across the Dr.Ayya platform.

1. Platform Scope & Operating Entity

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Patient", or "Practitioner") and Dr.Ayya Life Sciences Pvt Ltd ("Dr.Ayya", "We", "Our", or "Platform").

Dr.Ayya operates an integrated digital healthcare infrastructure offering:

  • Telemedicine consultations with registered AYUSH (Siddha, Ayurveda, Yoga & Naturopathy, Unani, Homeopathy) and integrative medical practitioners.
  • Direct-to-patient fulfillment of authenticated herbal wellness and botanical prescription formulations via licensed partner pharmacies.
  • Diagnostic home sample collection coordination with NABL-accredited partner laboratories.
  • Hospital OS, electronic medical records (EMR) management, and Ayushman Bharat Digital Mission (ABDM) ABHA integration.
  • Devi AI conversational triage and healthcare navigation support.

2. Teleconsultation Informed Consent & Regulatory Compliance

By scheduling an online consultation on Dr.Ayya, you explicitly provide informed consent under the Telemedicine Practice Guidelines jointly notified by the Ministry of AYUSH and the National Medical Commission (NMC):

Independent Clinical Judgment: Attending practitioners exercise complete independent medical judgment. A doctor may, at their clinical discretion, advise in-person clinical examination or hospital admission if remote evaluation is deemed insufficient.

Emergency Limitations: Telemedicine is not designed for acute, life-threatening medical emergencies. If you experience severe chest pain, acute respiratory distress, severe hemorrhage, or sudden neurological deficits, you must immediately contact emergency medical services (112 / 108) or proceed to the nearest emergency room.

Digital Prescriptions: Prescriptions generated on Dr.Ayya are digitally signed and valid across India. Practitioners will not prescribe prohibited controlled substances or Schedule X medications.

3. Pharmacy Dispensing & Herbal Medicine Standards

All medications, botanical extracts, kashayams, and classical formulations fulfilled through Dr.Ayya comply with the Drugs & Cosmetics Act 1940 and Drugs & Cosmetics Rules 1945:

  • Medicines are manufactured exclusively by licensed GMP-certified AYUSH pharmaceutical laboratories and dispensed by licensed retail pharmacies.
  • Schedule E(1) formulations are dispensed strictly upon electronic verification of an active, lawful medical prescription.
  • Patients are responsible for verifying package seals upon delivery and reviewing usage guidance provided by the attending practitioner.

4. Payments, Health Wallet & Cancellation Policy

All financial transactions are processed securely through PCI-DSS Level 1 compliant gateways (Razorpay) or the Dr.Ayya Health Wallet:

  • Consultation Cancellations: Free cancellation and 100% refund are available if requested at least 2 hours prior to the scheduled slot.
  • Doctor No-Show: If a practitioner fails to attend an appointment, a 100% immediate refund is credited to your wallet or original payment source.
  • Pharmacy Returns: Damaged, tampered, or incorrectly shipped medicines are eligible for free replacement or refund upon notice within 48 hours of delivery.

5. Devi AI Health Assistant — Terms of Use

Devi AI is an artificial intelligence triage and platform navigation assistant. Devi does not establish a formal doctor-patient relationship, does not issue formal diagnoses, and does not prescribe medications. All clinical decisions must be confirmed with a licensed human physician.

6. User Responsibilities & Account Security

You represent that you are at least 18 years of age (or have parental/guardian consent) and agree to provide truthful, accurate medical history. You are responsible for safeguarding your login credentials, OTPs, and health profile access.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Kanyakumari / Chennai, Tamil Nadu.

8. Users outside India

  • Nature of the service. Consultations are delivered by practitioners registered with the relevant Indian AYUSH council, from India, under Indian telemedicine guidelines. They are traditional-medicine consultations and do not replace emergency care, a prescription from a practitioner licensed in your country, or care that your local law requires to be delivered locally. In an emergency, contact your local emergency services.
  • Your responsibility. You confirm that receiving a tele-consultation from India, and importing any medicines we ship, is permitted where you live, and that you are responsible for customs duties, import restrictions and declarations at your end.
  • Prescriptions. A prescription issued on Dr.Ayya is valid for dispensing through our export pharmacy only; whether a pharmacy in your country honours it is that pharmacy's decision under local law.
  • Pricing and payment. Services for users outside India are priced in a foreign currency from the international rate card, charged by card, and are an export of services from India. Refunds are governed by section 5 of the Refund Policy.
  • Data. Your health records are stored in India under Indian law (including the DPDP Act) and the Privacy Policy; by using the service from abroad you consent to that transfer.
  • Law and disputes. Section 7 applies. Nothing in these Terms limits rights you have under mandatory consumer law in your country of residence.
